DESCRIPTION
Retail has evolved over the last ten years thanks to the rising popularity of online shopping and e-commerce. To remain relevant, many longstanding retailers have changed their traditional approaches, innovating more, and restructuring or changing their business models.
But innovation is a double-edged sword. It can sometimes be a springboard for a company to restructure; and other times it can lead fast growing innovative companies (or start-ups) to a sudden crisis.
Join this session held by the AIJA T.R.A.D.E. and INSOLVENCY Commissions. We will speak about how a retailer can face this digital turmoil. On one hand, it can be about redefining their business model and ethics to position vis-à-vis the market platforms. On the other hand, we can look at how they can restructure effectively. The first part of the session will be animated by many “success” and “failure” stories drawn from the recent past.
During the second part attendees will test their skills in preparing a pitch on a restructuring plan for a retail company. The audience will be the jury and they will vote for the pitch that was the most convincing!

SPEAKERS & MODERATORS
Ricardo Gama started as an intern with Veirano Advogados in 1999 and, since 2013, is a partner in their Rio de Janeiro office. Ricardo has a very broad experience in litigation, including insolvency and transborder complex litigation/arbitration cases. He graduated from the Federal University of Rio de Janeiro in 2001 and has an LL.M from the University of Virginia, in the US (class of 2008). In addition to his experience as attorney, he has also partnered with international companies, such as Alvarez & Marsal and Delloitte, to render services as trustee in judicial reorganization and bankruptcy liquidation proceedings in Brazil.
Stéphanie Oneyser, is a Senior Associate at Walder Wyss Ltd (Zurich, Switzerland). She is part of the Litigation and Arbitration Team. She advises in dispute resolutions and represents parties in state courts proceedings, in enforcement and legal assistance matters and in international arbitration proceedings. Her practice focuses on dispute resolution in all aspects of commercial law and on insolvency law.”
Tsvetelina Georgieva is Senior Associate at DPC Law Firm at Sofia, Bulgaria. She is specialising in dispute resolution, including commercial litigation, arbitration, insolvency, interim measures, debt collection, medical malpractice, insurance and defamation disputes. She is also experienced in AML matters.
Marnix van den Bergh is a lawyer and partner at Höcker Advocaten in the Netherlands. Marnix focuses on commercial contracts, corporate/M&A and teaches lawyer’s ethics. Cooped up during the pandemic, he is now training for a pilot license as a new hobby
Manish Bahl is an Amsterdam based dual qualified lawyer (admitted in the Netherlands and England & Wales) specializing in core competition, commercial law and regulatory issues, covering both disputes and transactional matters. After working at leading firms (CMS, Clifford Chance Netherlands and, as a partner, at Eversheds Sutherland Netherlands and Fieldfisher Netherlands), in 2021 he set up Bahl & Co., a modern, progressive law firm focusing on quality and successful and sustainable legal solutions in the (post-) Covid-19 and Brexit reality.
Manish has studied law in Edinburgh, Leiden and London and has lived in seven countries in Europe, the Americas, Africa and Asia. He enjoys family-time, reading, food, wine, cold IPAs and beer, running, cricket, history, public international law cases, travelling.
Max is the founding partner of E2M – Etude Max Mailliet, a Luxembourg law firm specialized in insolvency and the combat of fraud and asset tracing. He is in love with insolvency law, up to a point that he decided to write a book about the subject. He is a (partly self-proclaimed, but also certainly peer-recognized) insolvency law guru in his jurisdiction.
He is regularly appointed by the Luxembourg Courts as an insolvency receiver in complex and cross-border insolvencies.
Armando is partner at Pozzi & Partners, a law firm based in Milan and with offices in the most important Italian cities.
He has been involved in the Insolvency commission of AIJA for several years.
Armando is mainly focused on turnaround management and commercial litigation. He is trustee at the Bar of Napoli.
His motto on the subject of the panel is: «if you only have one strategy, you have no strategy»
Geraldo Fonseca is a Brazilian attorney with extensive expertise in Insolvency Law. He is the founding partner of Fonseca Vannucci Abreu Advogados (FVA), a mid sized law firm based in Sao Paulo and Campinas.
Geraldo is Professor of Private Law at the Catholic University of Campinas and holds a Ph.D. and a Master’s Degree from the Catholic University of Sao Paulo. He has published several books on Insolvency and is a Member of the National Justice Council’s Committee in charge of improving the insolvency proceedings in Brazil.
He has also experience in moderating legal discussions and his two little daughters, who every now and then argue over complex matters.
